Informal Resolution

Binding Arbitration

If we cannot resolve a dispute through informal means, you agree that any dispute, controversy, or claim arising out of or relating to these Terms of Use or our services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

  • Arbitration shall take place in St. Louis, Missouri, United States
  • The arbitration will be conducted in the English language
  • You waive your right to a jury trial and to participate in class action lawsuits
  • The arbitrator's decision shall be final and binding

Exceptions

Notwithstanding the above, either party may seek injunctive relief or other equitable remedies in any court of competent jurisdiction to protect intellectual property rights or prevent irreparable harm.

Applicable Law

These Terms of Use shall be governed by and construed in accordance with the laws of the State of Missouri, United States, without regard to its conflict of law provisions.

Any legal action or proceeding arising out of or relating to these Terms of Use that is not subject to binding arbitration (as described in the Dispute Resolution section) shall be brought exclusively in the state or federal courts located in St. Louis, Missouri, United States.

You consent to the personal jurisdiction of such courts and waive any objection to venue in such courts.

Modifications

We reserve the right to modify these Terms of Use at any time. Changes will be effective immediately upon posting on serenemyglow.ddd. Your continued use of our services constitutes acceptance of modified terms.
